As a part of its business, ACETHETIK displays advertisements and product listings issued by other third parties.

As a courtesy, and not as an obligation, to any persons claiming to own any intellectual property rights to the advertisements and products listed on the site, ACETHETIK may perform a limited investigation, pursuant to any reasonable complaints made in this regard. However, ACETHETIK provides no guarantee that it will remove the allegedly infringing materials from the site, unless it has been finally established before a court of competent jurisdiction that the advertisements or products violate such person’s intellectual property rights.

If any person believes that their copyright or intellectual property rights have been violated or is being used on this site without permission, by ACETHETIK or by a third party who has advertised or listed their products on this site, such person is hereby requested to provide the following information to ACETHETIK:

1. A description of the copyright or other intellectual property rights that such person owns along with documentary evidence to substantiate any such claim;
2. A description of where the editorial content, graphics, advertisements or products that allegedly infringe upon such person’s copyright or other intellectual property rights is/are located on the site;
3. An address, a telephone number, and an e-mail address where ACETHETIK or the concerned third party, as the case may be, can contact such person;
4. A written statement by such person to the effect that such person has not, either by itself, or through its agents or by law, authorized or assigned to ACETHETIK or the concerned third party, as the case may be, its copyright or other intellectual property rights to such editorial content, graphics, advertisements or products; and
5. An affidavit by such person, under penalty of perjury, that the information in the notice is accurate and that such person is the owner of the copyright or intellectual property rights, to such editorial content, graphics, advertisements or products.
6. All such information shall be furnished in writing, be duly signed and addressed to ACETHETIK’S corporate office situated at:

ACETHETIK may request additional information to enable it to determine whether or not editorial content, graphics, advertisements or products infringe upon such persons copyright or other intellectual property rights before removing the same from the site.

ACETHETIK reserves the right to furnish the aforesaid information to the concerned third party in the event that the complaint pertains to any advertisements or products of such third party. Such third party shall have the right to respond directly to the person making the complaint.

Notwithstanding the above, it is recommended that any person who believe their intellectual property rights are being infringed upon by the third party who advertises or lists its products on the site, resolve their disputes directly with the concerned third party. ACETHETIK is not in a position to arbitrate disputes between any persons claiming to own the intellectual property rights to such advertisements and products and the third parties who advertise or list their products on the site.

The person making the complaint shall be liable to indemnify and hold indemnified ACETHETIK from and against any and all claims, expenses (including reasonable attorney’s fees) and damages that may arise on account of any such complaint made by it and any action taken pursuant thereto by ACETHETIK.

If a dispute develops as to who the correct owner of the copyright and other intellectual property rights in question are, ACETHETIK reserves the right to remove the allegedly infringing advertisements or product listings from the site pending resolution of the dispute. ACETHETIK shall not be liable in any manner whatsoever for the consequences that may arise on account of its withdrawing the allegedly infringing advertisements or product listings from the site.

If a third party’s advertisements or product listing has removed based on a complaint received from another person to the effect that the same violates such person’s copyright or other intellectual property rights, ACETHETIK will provide such third party with notice of such removal and the reasons therefor. ACETHETIK will also provide such third party with the contact details of the person making the complaint to enable both parties to attempt to resolve the issue directly between them. ACETHETIK will restore the advertisement or product listing upon notification in writing from the person making the complaint that the dispute has been resolved.

The third party whose advertisements or products are listed on the site shall be liable to indemnify and hold indemnified ACETHETIK from and against any and all claims, expenses (including attorney’s fees) and damages that may arise on account of the advertisements or products listed by it on the site.

Any and all disputes hereunder shall be subject to the laws of the Republic of India and the courts in Bangalore, India shall have exclusive jurisdiction.

PERMISSIONS AND REPRINTS PAGE:

1. Any person may download, reformat, and print a limited amount of ACETHETIK’S content, so long as the same is for such person’s personal, non-commercial use.
2. Any person may include excerpts or limited portions of ACETHETIK’S information in printed memos, reports, and presentations, so long as they attribute this information to ACETHETIK by incorporating, along with the excerpts, the following copyright statement and credit - "USED WITH PERMISSION FROM ACETHETIK CONSULTANTS PRIVATE LIMITED. ALL RIGHTS RESERVED."
3. Any person may link from another site on to ACETHETIK’S online content, including any reviews, articles, features, and video and audio clips.
4. Any other reproduction of ACETHETIK’S content would require the prior written permission of ACETHETIK and payment of license fees, as maybe applicable on a case to case basis.
5. Any and all commercial use of ACETHETIK’S content would require ACETHETIK’S prior written permission, including the following:

• Use of ACETHETIK’S content in advertisements or promotions;
• Use of ACETHETIK’S trademarks or logos; and/or
• Use of quotes, excerpts, or full text of ACETHETIK’S reviews, articles, or features.

6. ACETHETIK does not allow the reposting of its online content (including video, audio, webcasts, text, graphics, layout, and code) on any other web site or a public discussion board. All ACETHETIK’S video clips and webcasts are protected by applicable copyright laws and may not be copied without the express permission of ACETHETIK. Any person wanting to repost the same may do so only after obtaining a prior written license to that effect from ACETHETIK.
7. ACETHETIK’S broadband video clips and webcasts are available in VHS, Beta, and CD Master for commercial, non-broadcast, and offline uses and the same may be purchased from ACETHETIK’S Permissions Department, either by submitting a permissions request form, or, by contacting ACETHETIK directly.
